Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Whyston web application at whyston.com and the Whyston PowerPoint add-in (collectively, the "Service"), operated by Vitero Corp s.r.o., a company incorporated in the Czech Republic (company reg. no. 10675400), with registered office at Primátorská 296/38, 180 00 Prague 8, Czech Republic ("Whyston", "we", "us"). By using the Service, you agree to these Terms.

1. Service description

Whyston is an AI-powered presentation generation platform. It produces slide decks from text prompts using large language models. The Service is provided "as is" and may change, improve, or be discontinued at any time.

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this requirement.

Your content: You retain ownership of the prompts you submit and the presentations generated from them. We do not claim any intellectual property rights over your generated content.

Our service: The Service, including its design, code, features, and documentation, is owned by Whyston and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

7. Usage quotas and billing

Each account is subject to a monthly generation quota. Quota limits and pricing may change with notice. Unused quota does not carry over between billing periods. Paid subscriptions are processed by our payment provider, Polar; your payment information is handled by Polar in accordance with its terms.

8. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Third-party services

The Service relies on third-party providers (AI model providers, hosting, authentication). We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of the Service may be subject to additional terms imposed by these providers.

10. Limitation of liability

To the maximum extent permitted by applicable law, Whyston shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via the email address associated with your account or through a notice in the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by and construed in accordance with the laws of the Czech Republic. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.
